Consultation: consent in relation to sexual offences

The Criminal Law Committee contributed to a submission to the NSW Law Reform Commission’s consultation paper on consent in relation to sexual offences. The Law Society submitted that from a criminal justice perspective, the current Crimes Act 1900 (NSW) s 61HE strikes the right balance between the complainant, who states she/he did not consent (to a sexual act) and the accused, who states he/she did not know that the complainant was not consenting.
