A summary of recent NCAT decisions involving solicitors.
Council of the Law Society of New South Wales v Kazas-Rogaris [2026] NSWCATOD 62
On 6 May 2026, the New South Wales Civil and Administrative Tribunal (Tribunal) published its (stage 1) decision in relation to two disciplinary proceedings that the Council of the Law Society of New South Wales (Council) commenced against Anne Kazas-Rogaris, on 1 September 2023 (First Application) and 17 October 2023 (Second Application).
The Tribunal found Ms Kazas-Rogaris guilty of unsatisfactory professional conduct and professional misconduct in relation to the First Application. The Tribunal considered that Ms Kazas-Rogaris’ conduct the subject of the First Application (which involved her witnessing a mortgage for a client, the amount advanced pursuant to which was in breach of Court orders):
- fell significantly short of the standard of competence and diligence that a member of the public is entitled to expect of a reasonably competent lawyer; and
- involved a substantial failure to maintain a reasonable standard of competence and diligence pursuant to s 297(1)(a) of the Uniform Law.
The Tribunal was not satisfied that the conduct on the subject of the Second Application amounted to unsatisfactory professional conduct or professional misconduct and dismissed that application.
The (stage 2) hearing regarding disciplinary orders is listed to be heard in early 2027.
