Motor Accidents Compensation Regulation 2015

In the ethics column appearing in the March 2015 edition of the LSJ, we discussed the proposed Motor Accidents Compensation Regulation 2015. The Regulation’s operational date is 1 April.

It contains clause 24, which prohibits both the paying and receiving of referral fees by a solicitor or their close associate. Solicitors acting in that area of law will need to be careful of this prohibition.

It means that you will have to comply with its stricter obligations, beyond what rule 12 of the Conduct Rules requires. You will also need to note that the wording used is not the same as rule 12 – for instance, ‘close associate’ is defined differently in the Regulation compared to ‘associate’ in the Conduct Rules.
