Prothonotary of the Supreme Court of New South Wales v Yousif [2025] NSWCA 77
Decision published: 23 April 2025
On 23 April 2025, the New South Wales Court of Appeal (Court of Appeal) published its decision in disciplinary proceedings that the Prothonotary of the Supreme Court of New South Wales (Prothonotary) commenced against a solicitor, Ms Alina Yousif.
In the proceedings, the Prothonotary sought a declaration that Ms Yousif was not a fit and proper person to remain on the Roll of Australian Lawyers (Roll) and an order removing Ms Yousif’s name from the Roll. The application followed Ms Yousif’s conviction on 2 March 2020 of the following offences:
- One count of participating in a criminal group in contravention of section 93T (1) of the Crimes Act 1900 (NSW) (Crimes Act).
- One count of using a false document with the intention of inducing a person to accept it as genuine and then to influence that person to exercise a public duty in contravention of section 254(b)(iii) of the Crimes Act.
- One count of knowingly taking part in the supply of a prohibited drug, namely 55.5 grams of methylamphetamine in contravention of section 25(1) of the Drug Misuse and Trafficking Act 1985 (NSW).
The Court of Appeal made the declaration and orders that the Prothonotary sought on the basis of it being satisfied that Ms Yousif was not fit to remain on the Roll.
