Water Management Regulation remake
The Law Society recently submitted feedback to the NSW Department of Climate Change, Energy, the Environment and Water’s consultation on the draft Water Management (General) Regulation 2025 (‘General Regulation’) and draft Water Management (Water Supply Authorities) Regulation 2025.
Our submission, informed by our Property Law and Rural Issues Committees, broadly focused on Part 7 of the General Regulation which pertains to private water corporations and private water trusts. We suggested that:
- proposed section 129 of the General Regulation be amended such that the member of the private water entity provides notification of the sale of land both before and after the sale; and
- proposed section 133 of the General Regulation be amended to remove references to the 2018 Regulation and the substance of the relevant provisions for the calculation of charges for illegally taking water be carried over to the General Regulation.
