Review of the NSW Home Building Compensation Scheme

The Property Law, Business Law and Litigation Law and Practice Committees contributed to a Law Society submission to the State Insurance Regulatory Authority, in response to its Review of the NSW Home Building Compensation Scheme (‘HBCS’).

Under the HBCS, home building compensation insurance is required for home building work which is valued at $20,000 or more. It is a scheme of ‘last resort’ covering defective or incomplete home building work, which allows homeowners to make a claim on the insurance if their builder dies, disappears, becomes insolvent or the builder’s licence is suspended.
