Standard non-parole periods – identifying objective seriousness within a notional range – whether essential, useful, unhelpful or an error – ongoing controversy

In this decision, the Court of Criminal Appeal (‘CCA’) held that, whilst it is not essential for judges to identify objective seriousness on a notional range when sentencing for matters with a standard non-parole period (‘SNPP’), nor will it be an error to do so. This played out against the background of ongoing disagreement amongst members of the CCA about whether the practice should continue.
