Administrative Review Council migration inquiry

The Human Rights Committee contributed to a submission to the Law Council of Australia (‘Law Council’) in response to the review of the Administrative Review Council and aspects of merits review of migration decisions in the Administrative Review Tribunal (‘ART’). In our submission, we addressed specific questions within the issues paper.

In relation to primary decision making on visa matters by the Department of Home Affairs (‘Department’), we raised concerns with the quality of decision making, delays associated with the process, misapplication of law by the Department as reported by our members, and the procedural fairness afforded to applicants in the process.
